CHANGE OF POLICY

Terms and conditions, policies, pricing and services are subject to change at any time and apply to all users of Fringe Yoga. Please check our pricing options and terms of agreement before purchase.

Any dispute related to these Terms and Conditions will be governed by English Law and the Courts of England.

CLASS PASSES

Class passes purchased must be used before the expiry date and unused passes cannot be transferred or carried over. In exceptional circumstances an extension may be granted by Fringe Yoga acting in their sole discretion. 

5 class pass - 2 months from date of purchase 
10 class pass - 3 months from date of purchase

Passes automatically expire at the end of their expiry date. We are unable to extend passes if they are unused within the date specified. We plan our classes on the basis of passes purchased and attendance; accordingly, we ask that you book your chosen class as soon as possible. If you book but are unable to attend for whatever reason you must cancel your space in class within 12 hours of the class start time. Cancellations after this time will be classed as attended and we are unable to offer a refund. No shows are charged in full for class so please ensure you cancel your spot if you cannot attend. 

CLIENT CLASS CANCELLATION

Class Passes and Drop-in
Clients may cancel their class up to 12 hours before the start time and receive a full refund on to their class pass or fringe account. Cancellations made after this time will be charged in full. 

Cancellation by a Member
We ask that members cancel their booked space in class as soon as possible before the start time to enable their space at the class to be enjoyed by another student.

Cancellation by Fringe
Given we are unable to offer private tuition at our group class prices, if for any reason a class is under booked or unforeseen circumstances arise, we will inform clients booked into class as soon as practical and refund the fee or credit client accounts, as appropriate or applicable. We cannot guarantee against disruption of services provided, this may include a discontinuation of services, prices, a break in software use or any technical failure. 

MODIFICATIONS TO SERVICES AND PRICES

Fringe Yoga is not liable and reserves the right at any time to modify, suspend, discontinue or change prices and services offered without notice. This is inclusive of but not specific to class schedule and/or teachers, equipment, workshops and pricing. 

Once you confirm your class booking status, if an issue arises and the class must be cancelled you will be notified as promptly as possible and a refund/credit issued. This may also include a reduction in our class schedule, reflected by attendance, availability of instructors and any other unforeseen circumstances. Every effort will be made to offer an alternative but if you have questions about your classes or your account please get in touch at info@fringe.yoga

Details of classes, times and teachers at Fringe Yoga studio and/or online may vary from time to time. Where possible these details will be published on the Fringe page of the MindBody App and website. 

BILLING AND ACCOUNT INFORMATION

Fringe Yoga reserves the right to refuse client participation or any purchase of services provided. 

As part of your purchase (single, membership or otherwise) agreement you agree to provide and keep up to date current, complete and accurate payment information to reflect any changes which may impair your account and billing information. 

MEMBERSHIP AGREEMENT

By purchasing this membership you agree to use this membership in accordance with the terms and conditions on our website (www.fringe.yoga) which includes, but is not limited to you agreeing to the following: 

  • Payments will be taken monthly, in advance. A member wishing to terminate a membership must give one month’s fully paid cancellation notice in writing to info@fringe.yoga. You will be entitled to continue to enjoy your membership benefits throughout the month’s notice period.

  • In line with our T&C’s you agree to provide and update current, complete and accurate billing information at all times. 

  • Provided payments are kept up to date, this membership allows you access to unlimited classes (unless otherwise specified) from the date of purchase. 

  • Full T&C’s apply throughout period of membership (including auto renewal, frozen/suspended payments).

  • You understand and accept fluctuations in schedule and teachers, and that undersubscribed classes may be discontinued. 

  • Please note that memberships are not valid for workshop and courses, places for these will need to be booked separately on the Mindbody app/website and payment will be additional. 

Fringe Yoga reserves the right to terminate client accounts and/or memberships without prior notice.

Declined Payments and Termination of Membership Agreement
As part of our membership agreement, we would like to remind you that all declined or unsettled payments will still be active on our system and therefore you are liable for these payments. In respect of this we ask that if you wish to cancel your current membership you adhere to our one calendar month’s fully paid notice as per our cancellation policy rather than ceasing payments without notice. Please note that all declined/unsettled payments and in addition any due within the one month notice period will continue to be processed by Fringe Yoga.

Termination of Frozen/suspended Memberships
Any requests of membership termination on frozen accounts will be processed as specified in our cancellation policy of one calendar month’s fully paid notice. Memberships will remain active during this payment period and can be used to attend both studio and/or online classes where applicable.

CONDUCT AND BEHAVIOUR

  • Clients are requested to wear appropriate clothes for the practice of yoga

  • Footwear should be removed on entry to the premises and left in the racks provided or entrance hall

  • Mobile phones must be either on silent or switched off entirely to avoid disruption in class. 

  • Fringe Yoga reserves the right to withdraw, suspend or refuse the membership of any member or client whose conduct is, or may be deemed to be in Fringe Yoga’s reasonable opinion, injurious to Fringe Yoga, their teachers, reputation and/or enjoyment of the classes by other students or amounts to a breach of the Terms and Conditions or where such expulsion is otherwise to be in the interests of other students. Any student expelled shall forfeit all membership benefits and shall not be entitled to any refund for any period during which the membership is suspended. 

  • Fringe Yoga reserves the right to take legal action against anyone who is found to harass, abuse, insult, harm, defame, slander, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age or ability

  • If Fringe Yoga is unable to resolve any given situation to your satisfaction, we ask you to set down your complaint in writing and email it to jodie@fringeyoga. We will acknowledge receipt of your complaint within 3 working days and then investigate the complaint. As this may involve speaking to third parties we will allow ourselves 2 weeks to do this and respond. If we need further information this will be obtained within this 2 week period. At the end of this 2 week period we will contact you with our findings. Fringe Yoga’s decision shall be final.

ONLINE PARTICIPATION

In line with our waiver, clients assume full personal responsibility for the consequences of their activity/conduct, and Fringe.Yoga waives all liability of claim.

Please be aware that you may sometimes experience a disruption of services due to a break in software use or technical failure. 

ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site or service which contains errors, inaccuracies and omissions that may relate to product/service descriptions, pricing, promotions, offers, training, charges and availability. We undertake no obligation, except as required by law, and therefore reserve the right to correct, change, amend or update this information at any time.

PRIVACY POLICY

Fringe Yoga collects and processes personal data from you in order to provide a service. Fringe Yoga does not share your personal data with any third party. When making a booking, or attending the studio/online you are obliged to provide us with your name, postal address and email address and phone number. We may ask for additional information in order to improve our services to you but you are under no obligation to provide this additional information. By providing this personal data to Fringe Yoga you hereby consent to the processes of such personal data. 

If you use the Mind Body App to book your place on a class you will be bound by their own data protection policy.

INTELLECTUAL PROPERTY

In addition to other prohibitions and terms set out in our Terms and Conditions, you are prohibited from using any information shared on site or at the studio.

As a client or student of Fringe Yoga you agree that you will not infringe upon or violate our property rights. This includes but is not limited to; written text, spoken word, pictorial/photographic/film/voice documentation. The fringe method and all it’s resources is the copyright of Jodie Merrick.

Clients must not record or document any classes, workshops or training programmes unless prior permission is sought and agreed to.

FORCE MAJEURE 

There may be exceptional and/or unforeseeable circumstances beyond Fringe Yoga’s control, which may result in disruption, suspension or closure of services. Fringe Yoga is not liable for any claims under these circumstances. 

COVID-19 POLICY (Our full policy can be found displayed in our studio)

Whilst Fringe Yoga has taken a number of measures to attempt to minimise your risk of my contracting Covid-19 from visiting the studio and/or attending class at Fringe Yoga. I undertake to enter the studio at my own risk. For my own safety and that of our teachers, staff and other students that if I am feeling unwell or showing any symptoms of feeling unwell, I undertake not to visit the studio nor attend class there. I understand and accept that Fringe Yoga waives all liability in relation to any loss suffered as a result of contracting Covid-19 either directly or indirectly from attending class or visiting at the Fringe Yoga studio. 

Participation is a personal choice, please choose accordingly.

GRATITUDE

Our policy supports the aim of offering diverse, knowledgeable, well trained teachers who travel to our studio to teach classes whilst being paid for their time through your purchase of memberships and class passes. We are grateful to our students and teachers at Fringe Yoga – thank you for your support.
